Case: Appeal to the District Court of a drug possession conviction

Caught with 0.5 grams of cocaine and 3 grams of cannabis while entering a music festival.

Outcome We Achieved

Appeal upheld and resentenced under section 10(1)(a) of the Crimes (Sentencing Procedure) Act.
That means the charges were dismissed.
Our client’s conviction was struck out and she wasn’t even put on a good behaviour bond.

We submitted to the Court that the weight of the drugs was inaccurate because it included the weight of the plastic bags they were contained in. We then explained the awful events in our client’s life that had triggered her drug use, as well as her attempts to change her behaviour, including moving states and starting a new career. That helped us to finish our submissions by relying on her (very) good character, remorse, and the effect of a criminal conviction on her future.

Case: Driving With Suspended Licence

Drove 6 minutes from home to a train station during a demerit point licence suspension.

Outcome We Achieved

Sentenced under section 10(1)(b) of the Crimes (Sentencing Procedure) Act.
That means NO conviction, and a 12-month good behaviour bond.

We relied on our client’s need for a license. She helps her single mother out by driving her siblings to and from school, as well as attending work and University.

His Honour reminded our client of the dangers of driving without a license, referring to the devastating 2017 crash caused by a driver without a license, which killed the entire Falkholt family.
